PLEASE READ THESE TERMS OF USE CAREFULLY BEFORE USING THE GOTBOTTLE APP. BY DOWNLOADING, ACCESSING, OR USING THE APP, YOU AGREE TO BE BOUND BY THESE TERMS OF USE ("TERMS"). IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP.

1. Acceptance of terms

These Terms form a binding legal agreement between you ("User" or "you") and the operator of gotBottle ("gotBottle", "we", "us", or "our") governing your use of the gotBottle mobile application (the "App"), available on iOS and Android (together, the "Service"). By using the App you confirm that you can form a binding contract, that you accept these Terms, and that you agree to comply with them.

Our Privacy Policy is incorporated into these Terms by reference and describes how we collect, use, and protect information when you use the App.

2. Description of the service

gotBottle is a personal wine-cataloging application that helps you track, rate, and remember wines you have tried or own. Core features include:

3. No account required; your data

gotBottle does not require you to create a user-facing account or provide profile information to use the App. Your bottles, ratings, tasting notes, and photos are stored locally on your device. Some services may use technical or pseudonymous identifiers, including a Firebase Authentication identifier for Android subscription validation, as described in our Privacy Policy.

If you use the backup and restore feature, an export file containing your collection is created and stored wherever you choose to save it (for example, your device storage, a file-sharing service, or cloud storage you control). We do not host, receive, or have access to your backup files.

Because your data is stored on your device and any backups you create, you are solely responsible for safeguarding that data. Deleting the App, losing your device, or losing a backup file without a separate copy may result in permanent loss of your data. We are not responsible for any loss of data.

4. License to use the app

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a device that you own or control, solely for your personal, non-commercial use, in accordance with the applicable app store's terms of service.

You may not: (a) copy, modify, or create derivative works of the App; (b) reverse engineer, decompile, or disassemble the App, except to the extent such restriction is prohibited by applicable law; (c) rent, lease, lend, sell, sublicense, or otherwise transfer the App to any third party; (d) remove or alter any proprietary notices on the App; or (e) use the App for any commercial purpose not expressly permitted by us.

5. Subscriptions and payments

gotBottle offers optional auto-renewing subscriptions ("Premium") that unlock additional features, such as unlimited bottle storage and unlimited AI-powered bottle analysis, subject to reasonable technical, security, and abuse-prevention limits. Without a Premium subscription, a limited number of free AI bottle scans are available; the exact number and any related limits may change at our discretion.

5.1 Billing

Subscriptions are sold and billed exclusively through the app store from which you downloaded the App — the Apple App Store for iOS, or Google Play for Android. Pricing, currency, billing cycle (e.g., monthly or yearly), and any free trial or introductory offer are disclosed to you before purchase within the applicable store's purchase screen and/or the App's paywall.

5.2 Auto-renewal

Subscriptions automatically renew for the same duration and at the then-current price unless you cancel under the deadline and process shown by the applicable app store. Your payment method will be charged for renewal through your Apple ID or Google Play account, as applicable. The store's purchase screen and subscription terms control the billing cycle, renewal deadline, price, and any trial or introductory offer presented to you.

5.3 Managing and cancelling your subscription

You can review, manage, or cancel your subscription at any time through your device's account settings:

Cancelling stops future renewals but does not refund amounts already charged for the current period; access to Premium continues until the end of the paid period.

Payments and refund processing are handled through Apple or Google under their respective refund policies. We do not process payments directly or issue app-store refunds. This section does not limit any mandatory consumer rights that apply to you. Refund requests should be made through:

We may change subscription pricing from time to time. Any price change will be communicated as required by the applicable app store and will apply to renewals after you are given notice and, where required, an opportunity to decline the new price.

5.6 Grandfathered access

Users who were eligible under an earlier App version may retain legacy Premium access. Eligibility and any legacy entitlement are determined by the App's entitlement checks and the terms communicated for the applicable version. We may modify or discontinue grandfathered access only as permitted by applicable law and app-store rules.

6. Health, alcohol, and content disclaimer

The App is intended for adults of legal drinking age in their jurisdiction. The App is not intended to encourage excessive or irresponsible consumption of alcohol. Nothing in the App constitutes medical, legal, health, safety, or professional advice regarding alcohol consumption. Please drink responsibly and comply with all laws applicable to you.

7. AI-generated and third-party content; no professional advice

Wine profiles, tasting notes, valuations, wineries information, and other information suggested or generated by the App (including through AI-based label recognition) are provided for general informational and entertainment purposes only. This information may be incomplete, outdated, or inaccurate, is not verified by us, and should not be relied upon as a definitive or authoritative source about any specific bottle, vintage, producer, or price. You are responsible for independently verifying any information before relying on it, including for insurance, resale, collection valuation, or purchasing decisions.

8. Your content

You retain all ownership rights in the photos, notes, ratings, and other content you create within the App ("User Content"). gotBottle does not provide a hosted collection service and does not store or host your collection or backup files. The limited processing described in our Privacy Policy still applies; for example, text extracted from a wine-label photo may be sent to our AI provider solely to generate a wine profile. Full photos and personal notes are not transmitted for that purpose.

You are solely responsible for the User Content you create and for ensuring you have the right to any photos or information you add to the App. You agree not to add User Content that is unlawful, infringes another person's rights, or that you do not have the right to use.

The App, including its design, graphics, logos, icons, text, software, and all related intellectual property (excluding your User Content and third-party data described below), is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws. Except for the limited license granted in Section 4, nothing in these Terms transfers any intellectual property rights to you.

Wineries reference data displayed in the App may be sourced from third parties and is provided "as is" for informational purposes; we do not claim ownership of that third-party data.

11. Third-party services

The App relies on third-party services to operate, including Google Firebase (Analytics, Crashlytics, Authentication, Cloud Functions, and Firebase AI Logic/Vertex AI), Google Maps Platform and Google Play services on Android, Apple location and mapping services on iOS, and the Apple App Store and Google Play. These services are governed by their own terms and privacy policies, which we encourage you to review:

12. Disclaimer of warranties

THE APP AND ALL CONTENT AND FEATURES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY AI-GENERATED WINE INFORMATION WILL BE ACCURATE OR COMPLETE.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN SUBSCRIPTION FEES IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) FIFTY U.S. DOLLARS (US$50).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

14. Indemnification

You agree to defend, indemnify, and hold harmless gotBottle and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the App, your User Content, or your violation of these Terms or applicable law.

15. Termination

You may stop using the App at any time by deleting it from your device. We may suspend or terminate your access to the App, in whole or in part, at any time, with or without notice, including if we reasonably believe you have violated these Terms. Because the App does not use accounts, termination generally takes the form of discontinuing your access to updates or Premium entitlements; any Premium subscription must still be cancelled separately through Apple or Google as described in Section 5.


Apple App Store additional terms

If you downloaded the App from the Apple App Store, the following additional terms apply to you and take precedence over any conflicting terms in these Terms solely with respect to your use of the App on Apple devices:

The App is also distributed subject to Apple's Licensed Application End User License Agreement (the industry-standard EULA), currently available at: https://www.apple.com/legal/internet-services/itunes/dev/stdeula. That agreement governs the license Apple grants you to use the App on Apple devices; these Terms govern the Service, your use of its features, subscriptions, and your relationship with gotBottle. If there is a direct conflict between these Terms and Apple's Standard EULA regarding the scope of the license to use the App on an Apple device, Apple's Standard EULA controls.


Google Play additional terms

If you downloaded the App from Google Play, your use of the App is also subject to the Google Play Terms of Service and, for purchases, the Google Payments Terms of Service. Google is not responsible for the App and has no obligation to provide maintenance or support services for it.


16. Children's use

The App is intended only for people who are of legal drinking age in their jurisdiction and is not directed to children. By using the App, you represent that you meet the applicable age requirement in your jurisdiction.

17. Changes to these terms

We may update these Terms from time to time to reflect changes in the App, our practices, or legal requirements. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide notice through the App. Changes will not limit rights that cannot lawfully be waived, and we will obtain consent where required by law.

18. Governing law and dispute resolution

These Terms do not limit any mandatory consumer-protection rights available under the law of your country or region of residence. To the extent permitted by applicable law, any dispute arising from these Terms or the App that cannot be resolved informally will be determined by a court with jurisdiction under applicable law. Nothing in this section prevents you from bringing a claim in a forum available to you under mandatory law.
